The company Pak & Švehelka, advokátní kancelář s.r.o., with its registered office at Francouzská 171/28, 120 00 Prague 2, Company ID: 07003927 (hereinafter referred to as "the Law Firm"), protects all personal data processed in the provision of legal services as confidential and handles such data in accordance with applicable legal regulations.

The Law Firm, within the meaning of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation), acts as the controller of your personal data.

We process your personal data for the following reasons and purposes:

  • Fulfillment of the contract: (i.e. the contract for the provision of legal assistance or for meeting client requirements, i.e. the actual performance of legal services in accordance with the legal regulations governing the practice of law);
  • Fulfillment of legal obligations: (in particular, obligations under accounting and tax legislation, such as providing personal data to tax authorities or other public bodies in accordance with the relevant legal regulations; proper management of the legal file including e-mail communications, contact lists, and provided services);
  • Protection of the legitimate interests of the controller and third parties (in particular clients) in accordance with the rules governing the practice of law.

We process, in particular, the following personal data about you:

  • Title, first name, and surname;
  • Date of birth, personal identification number;
  • Identification number;
  • Permanent address, contact address;
  • E-mail address, telephone number;
  • Bank account number;
  • Information you provide to us in connection with accepting your legal representation in a specific matter;
  • Information provided by the opposing party or other persons during the handling of your legal matter, or from public registers.

We process personal data both manually and automatically, in paper and electronic form.

There is no automated decision-making or profiling.

The Law Firm makes your personal data available only to authorized employees, cooperating lawyers, or individually contracted data processors, or to other controllers, always only to the extent necessary to fulfill the respective purposes of processing and on the basis of an appropriate legal basis for processing personal data.

In cases provided by law, the Law Firm is entitled or obliged to provide some personal data based on applicable legal regulations, for example to authorities involved in criminal proceedings or to other public bodies.

We process and store your personal data for the period necessary to ensure all rights and obligations arising from the respective contractual relationship, and further for the period during which the Law Firm is obliged, as the data controller, to retain personal data according to mandatory legal regulations—typically for a period of 10 years from the termination of the contractual relationship.

As a data subject, you have the following rights in connection with the processing of your personal data:

  • Right of access: If you wish to know whether the Law Firm processes personal data, you have the right to obtain information on whether your personal data are being processed, and if so, the right to access your personal data.
  • Right to rectification: If you believe that the Law Firm processes inaccurate or incomplete personal data about you, you have the right to request their correction or completion. The Law Firm will correct or complete the data without undue delay, taking into account technical possibilities.
  • Right to erasure: Should you request deletion, the Law Firm will erase your personal data if (1) they are no longer necessary for the purposes for which they were collected or otherwise processed, (2) the processing is unlawful, (3) you object to the processing and there are no overriding legitimate reasons for processing your personal data, or (4) the legal obligation to process as set out by EU law or national regulations no longer applies.
  • Right to restrict processing: If you request a restriction on processing, the Law Firm will restrict access to your personal data, temporarily delete or store them, or perform other processing actions necessary for the proper exercise of the right asserted.
  • Right to data portability: If you wish the Law Firm to transfer personal data about you that is processed electronically under a contract to a third party, you may exercise your right to data portability. If the exercise of this right would adversely affect the rights and freedoms of others, the Law Firm may not be able to comply with your request.
  • Right to object: You have the right to object to the processing of personal data that is carried out for the purposes of fulfilling a task performed in the public interest or in the exercise of official authority, or for the purposes of protecting the legitimate interests of the Law Firm. If the Law Firm cannot demonstrate that there is a compelling legitimate reason for processing that overrides your interests or rights and freedoms, it will cease processing based on your objection without undue delay.
  • Right to lodge a complaint: You may, at any time, submit your suggestion or complaint regarding the processing of personal data to the supervisory authority, namely the Office for Personal Data Protection, with its registered office at Pplk.
